Who these terms are with
These terms are an agreement between you and [LEGAL ENTITY NAME] ("Bender", "we", "us"), of [POSTAL ADDRESS]. They cover your use of the Bender app and the recordings you make with it.
By creating an account you accept these terms. Our privacy policy explains what we collect and how we handle it.
Who can take part
You must be 18 or older. You may record only in commercial premises, such as a shop, a restaurant kitchen, a workshop or an office, and only where the person who runs them has given you permission to record there. It is your job to get that permission before you start, and to stop if it is withdrawn.
Your recordings and our licence
You keep ownership of your recordings. When you upload one, you grant us a non-exclusive, worldwide, royalty-free licence to store, copy, process, modify and use it for training and evaluating machine-learning systems. The licence includes the right to sublicense the recording, for the same purposes, to research customers who are under contract with us.
The licence continues for a recording that has been delivered to a research customer, including after you close your account. You confirm that each recording you upload is yours to license, that you had permission to record where you did, and that anyone who appears in it agreed to be recorded.
Payment
We pay only for accepted sessions. Each task says what it pays, how accepted hours are counted, and what a session has to meet to be accepted. We review every session against its task. A session we reject is not paid, and neither is a session that breaks these terms.
The payment for accepted sessions is the whole of what we pay for your recordings and for the licence above.
What you must not record
- Anyone who has not agreed to be recorded. Keep other people out of frame unless they have said yes.
- Private homes, including your own.
- Anyone under 18, even with a parent's agreement.
- Anywhere you do not have permission to record, or anything that is against the law where you are.
We reject sessions that break these rules, and we may close the account that sent them.
Your account and ending it
You can delete your account at any time, in the app or by email. The privacy policy says what deletion removes and what it cannot.
We may suspend or close your account if you break these terms, misuse the app, or try to get a session accepted that does not meet its task. If we close your account for any other reason, we still pay for sessions accepted before it closed.
Liability
The app is provided as it is, while it is still being tested. We do not promise that it will always work, or that every recording will save or upload. Recording and uploading use your phone's battery, storage and data.
As far as the law allows, we are not liable for indirect or consequential loss, and our total liability to you is limited to what we paid you for accepted sessions in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit.
Changes and governing law
We may change these terms. We will tell you in the app or by email before a change takes effect, and using the app after that means you accept the change.
These terms are governed by the laws of [JURISDICTION], and the courts of [JURISDICTION] decide any dispute about them.
